Is the Ontario Standard Lease mandatory?
Yes, for most residential tenancies. Landlords must use the Standard Lease (Form 2229E) for written tenancy agreements. If a landlord doesn't provide it, tenants can request it in writing and the landlord must provide it within 21 days.
Can I add my own terms to the Standard Lease?
Yes, you can add terms in Section 15 (Additional Terms). However, any terms that conflict with the Residential Tenancies Act are void and unenforceable. Common void terms include 'no pets' clauses and security deposits.
What deposits can a landlord collect in Ontario?
Landlords can only collect a rent deposit (last month's rent) and a refundable key deposit equal to the replacement cost. Security deposits and pet deposits are NOT allowed in Ontario.
How long do I have to give the tenant a copy of the signed lease?
Landlords must provide tenants with a copy of the signed lease within 21 days of signing. If a landlord fails to do so, the tenant can withhold one month's rent until they receive it.
